The convict petitioner is serving Life Imprisonment at the Central Jail, Ajmer. His application for first parole has been rejected by the District Parole

Advisory Committee, Ajmer vide recommendations dated 19.01.2021, which are challenged in this writ petition.

On a perusal of the reasons assigned by the committee, we find that the only justification which has been offered by the committee is that the

petitioner does not have his own house in the jurisdiction of the Police Station Ganj and that his family resides in a rented premises. If the convict is

released on parole, the possibility of his absconding cannot be ruled out.

Suffice it to say that the Social Welfare Department has recommended the release of the convict petitioner on first parole. The apprehension that the

convict may abscond, if released on parole, can be taken care of by requiring him to furnish sound and solvent surety bonds.

Thus, the adverse recommendations passed by the District Parole Advisory Committee, Ajmer are quashed and set aside qua the petitioner.

Accordingly, the writ petition is allowed. It is hereby directed that the petitioner Abdul Hafij S/o Shri Abdul Rehman shall be released on first parole of

twenty days upon his furnishing a personal bond in the sum of Rs.1,00,000/- and two sound and solvent and duly verified sureties of Rs.1,00,000/- each

to the satisfaction of the Superintendent Central Jail, Ajmer on usual terms and conditions. The Superintendent, Central Jail, Ajmer shall be at liberty to

impose such other adequate and reasonable conditions to ensure return of the convict to the custody after availing the parole. The term of parole shall

be computed from the date of his actual release.
