The petitioner who is stated to be a Gaonbura of Askikandi village is before this Court assailing the order dated 22nd September, 2020, whereby he had been relieved of his duties as Gaonbura ostensibly on public complaints for a period of three months, and the respondents as an interim measure, had appointed respondent No. 3.
A perusal of the said impugned order indicates that the term of respondent No. 3 has also expired on 05-12-2020.
Mr. P.T.Sangma, learned counsel for the petitioner submits that presently, there is no Gaonbura of the village, nor has there been any election held to select a new Gaonbura. He further submits that the public are suffering and therefore prays that steps should be taken by the respondents to hold the election to select a new Gaonbura for the village.
Mr. S.Deb, learned counsel for respondent No. 1 fairly concedes the fact that the life of the impugned order has since expired and the writ petition in this that regard has become infructuous. However, he submits that it is not known whether there is any Gaonbura functioning in the village, or whether the election has been held after expiry of the term of respondent No. 3.
Be that as it may, as the challenge to the impugned order no longer survives, this petition is disposed of with a direction that if the election has not yet been conducted, or there is no new Gaonbura in place, in public interest, it is necessary for the respondent to conduct the election expeditiously.
With the above direction, matter stands closed and disposed of.
