ORDER
Adv. Meghana Arvind i/b MDP Partners appearing for the Applicant is present.
The above I.A is filed by the Mr. Raj Kumar Dad, IRP under Section 12A of the Insolvency and Bankruptcy Code for withdrawal of the CIRP order dated 06.06.2023 passed against the Corporate Debtor. The counsel appearing applicant submits the Corporate Debtor and Operational Creditor entered into consent terms dated 27.06.2023 even before constituting COC and therefore, the approval from COC does not require. The applicant also enclosed the form FA dated 27.06.2023 for withdrawal of the CIRP proceedings against the Corporate Debtor.
In view of the above facts and circumstances, this Bench feels that it is appropriate to allow the above application. Accordingly, the above I.A. no. 2814/2023 is allowed and the CIRP order dated 06.06.2023 passed against the Corporate Debtor stands disposed of as withdrawn by releasing the Corporate Debtor from all the rigorous of moratorium.
In view of the disposal of the main company petition, all pending I.A’s and M.A’s s, if any shall stand disposed of.
