Judgment
Heard on I.A. No. 02/2021, application for grant of ad- interim bail.
The applicant has been arrested in connection with Crime No.32/2021, registered at Police Station Kotwali, Korba (C.G.) for the offence punishable
under Section 22 (C) of the NDPS Act.
As per prosecution case, on receiving secret information by the police, the applicant along with co-accused was found in possession of 100 bottles of
Phensedyl Cough Syrup (100 ml. each from his vehicle.
Learned counsel for the applicant submits that the applicant is suffering from Covid-19 and his oxygen level is deteriorated. He submits that there is no
one to look after him in the hospital and therefore, he may be released on temporary bail.
On the other hand, counsel for the State opposes the application for grant of temporary bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, and further considering the fact that the
applicant is suffering from corona positive and lungs infection and no one is there to look after him in the hospital, I am inclined to release him on
temporary bail.
Accordingly, the prayer is allowed.
It is directed that the applicant shall be released on temporary bail for a period of two months on his furnishing a personal bond in sum of Rs. 50,000/-
with one local surety in like sum to the satisfaction of the concerned trial Court. Meanwhile, if the applicant is called for the proceeding before the trial
Court, he may appear in person or through his counsel. The applicant shall positively surrender himself before the concerned trial Court on 2ndJuly
2021 by 11.00 AM.
List the matter for final hearing thereafter. I.A. Nos. 02/2012 and 03/2021 stands disposed of.
