Judgment

Learned counsel for the petitioner would submit that the 3rd respondent who is the son of the petitioner had brutally assaulted the petitioner and thrown him out of his own house, due to which the petitioner is unable to enter into his house. Based on the complaint given by the petitioner, a case in Crime No.585 of 2025 dated 18.11.2025 for the offence under sections 126(2), 296(b), 115(2), 329(4) and 351(3) of the Bharatiya Nyaya Sanhita (BNS), 2023 has been registered. However, he contended that it is a civil dispute and the respondent police is not giving protection to the petitioner for entering into his house, though the petitioner is ready to go back to his house.
The learned Additional Public Prosecutor (Crl.Side) would submit that as on date, the 3rd respondent, who is the son of the petitioner is absconding.
The learned counsel for the petitioner is directed to take the petitioner to his house by 5 p.m. today and the respondent police shall ensure that appropriate protection is given to the petitioner at his residence.
