Judgment

By way of the instant misc. application, the petitioner has sought clarification of the order dated 27.07.2022, passed by this Court in petitioner’s S.B. Criminal Misc.(Pet.) No.4170/2022.
After hearing the petitioner and upon perusal of the order, this Court is of the view that para No.3 of the order is clear and accordingly the petitioner is required to pay Rs.15,000/- per month towards his arrears, while continuing to pay monthly maintenance of Rs.10,000/-.
The incongruity which has occurred in para No.7 of the above referred order is hereby clarified in the manner that the petitioner shall pay Rs.15,000/- per month towards the arrears of maintenance and shall continue to pay Rs.10,000/- per month as ordered by the family Court.
According to the petitioner himself a sum of Rs.1,00,000/- is outstanding as of today. He submitted that an arrest warrant has been issued against him by the trial Court, for enforcing recovery of such amount.
Having regard to the facts and circumstances of the case and considering that there was a bit of confusion in the order passed by this Court, it is hereby ordered that in case, petitioner deposits a sum of Rs.50,000/- towards the arrears on or before 31.03.2023, arrest warrant issued against him shall be kept in abeyance.
The petitioner shall continue to pay Rs.15,000/- per month towards the arrears till the same is not cleared, apart from paying monthly maintenance of Rs.10,000/-.
The present misc. application so also the stay petition stands disposed of.
