Judgment
T.R. Ramachandran Nair, J.—The petitioner is aggrieved by the reorganization of Mannarkad Block Panchayath and Sreekrishnapuram Block Panchayath. He is a member of the Karakkurussi Panchayath and the former President of the said Panchayath. According to the petitioner, the Karakkurussi Panchayath has been excluded from Mannarkad Block Panchayath and has been included in Sreekrishnapuram Block Panchayath.
Various allegations have been raised in the writ petition. Learned Government Pleader pointed out that the preliminary notification is dated 05.06.2010 and the final notification is dated 02.07.2010. These notifications are not under challenge in this writ petition and they have not been produced by the petitioner also. It is further pointed out that the delimitation process has progressed considerably and the petitioner has approached this Court only now and therefore, the writ petition is not entertainable. Any interference at this stage will delay the election process of all Panchayaths, contends the learned Government Pleader.
Evidently, what is produced as Exhibit P1 is only a covering letter forwarding the notification to the respective Panchayaths. Apart from that, the preliminary as well as final notification and other details are not available in the writ petition.
I find that the relevant notifications are not under challenge in the writ petition and the writ petition is also delayed in the sense that the delimitation process is at the final stage.
Therefore, this writ petition is dismissed.
