Judgment
Learned counsel for the petitioner, Mr. Himanshu Dhawan seeks permission to file an MA for challenging demand of licence fee also on the ground
that such demand is impermissible because petitioner is being required to pay licence fee on Pure Internet Service alone. According to him, this is
impermissible in view of recent judgement of this Tribunal.
Learned counsel for the respondent has pointed out that the prayer as made today, can not be allowed in view of provisions in the agreement and,
therefore, no interim relief should be granted at this stage. He also submits that the matter relating to licence fee on revenue from Pure Internet
Services is now lying with the Hon'ble Supreme Court with a limited interim relief in favour of Union of India.
The petitioner is permitted to make amendments in the petition by filing appropriate MA. Let that be done within two weeks.
The prayer for interim relief shall be considered on the next date. But till then, no coercive step should be taken against the petitioner for realisation
of the impugned demand for further licence fee.
Post the matter under the same head on 24.2.2021.
