This Original Application has been filed against the inaction on behalf of the respondents whereby revision petition dated 28.01.2022 (Annexure A-6) has not been decided yet.

The facts of the case is that the applicant has been inflicted penalty of ‘dismissal from service’ vide order dated 10.06.2017 (Annexure A-2). The appeal filed by the applicant on 24.07.2017 (Annexure A/3) has been rejected by the respondents vide order dated 07.05.2018 (Annexure A/4). The applicant has been exonerated from all the charges vide IV ADJ Narsinghpur order dated 12.11.2021 (Annexure A-5). Thereafter the applicant preferred revision petition dated 28.01.2022 (Annexure A/6) to respondent No.2, which is still pending for consideration.

At this stage, learned counsel for the applicant submits that the applicant will be satisfied if the respondents are directed to decide applicant’s revision petition dated 28.01.2022 (Annexure A/6) in a time bound manner.

Learned counsel for the respondents submits that he has no objection if the Original Application is disposed of as per law in above manner.

This Tribunal has considered the matter and is of the view that natural justice will be met if the competent authority of the respondents is directed to decide the revision petition dated 28.01.2022 (Annexure A/6) in a time bound manner.

Resultantly, the competent authority of respondents is directed to decide the applicant’s revision petition dated 28.01.2022 (Annexure A/6), if not already decided, within a period of 90 days after receiving the copy of this order.

Needless to say that the respondents shall pass the reasoned and speaking order. Respondents shall also deal with all the contentions raised in the revision petition dated 28.01.2022 (Annexure A/6).

With these observations, this Original Application is disposed of at admission stage itself.

However, is it made clear that this Court has not commented anything on the merits of the case.
