Judgment
The prayer in this application is to grant permanent injunction against respondent Nos.5 to 7 from undertaking any construction activity in Survey No.141 of 76, Saduranga Pattinam Village, Thirukazhukundram Taluk, Kancheepuram District except in accordance with law.
The grievance raised is that the authorities are contemplating to construct Marine Police Station at Survey No.141 of 76, Saduranga Pattinam Village, Thirukazhukundram Taluk, Kancheepuram District which according to the applicant is that such construction would be contrary to the CRZ Notification and the proposed construction is not a permissible activity as per CRZ Notification, 2011.
The learned counsel appearing for the respondent has produced copy of the CRZ clearance dated 03.11.2016 granted for the said project of construction of Marine Police Station at Survey No.141, copy of which has been handed over to the learned counsel appearing for the applicant on 03.03.2017.
In view of the subsequent event of granting of CRZ clearance for the proposed project, the prayer in the application no more survives. Accordingly, giving liberty to the applicant to work out his remedy in the manner known to law except challenging the proceedings of the CRZ Clearance dated 03.11.2016.
With above direction, the application stands closed as the prayer has become infructuous.
