Judgment
V. Narasingh, J
1.Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is an accused in S.T. Case No.29 of 2023 pending in the Court of learned Assistant Sessions Judge (Special Track Court)-cum-Registrar, Berhampur, arising out of Baidayanathpur P.S. Case No.140 of 2022 for commission of the offence under Sections 498-A/326/307/34 IPC.
Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned Asst. Sessions Judge (STC), Berhampur, by order dated 20.11.2023 in the aforementioned case, the present BLAPL has been filed.
This Court by order dated 17.10.2023 in BLAPL No.9458 of 2023 after considering the statement of P.W.1-the wife, was not inclined to entertain the bail application of the Petitioner.
In the considered view of this Court there is no change in circumstance to entertain this bail application. Hence, the BLAPL is accordingly stands disposed of.
Learned Court in seisin is requested to expedite the trial.
