Judgment

I.A. NO. 1099 OF 2023
Heard learned counsel for the petitioners and learned counsel for the State.
The petitioner is an accused in connection with G.R. Case No. 528 of 2023, pending before the Court of the learned J.M.F.C, Konark, arising out of Konark P.S. Case No. 158 of 2023 for alleged commission of offences under Section 394 of IPC.
Taking into account the recitals of the I.A. and the certificate issued by the counselor, that the father of the Petitioner passed away on 11.08.2023, this Court on humanitarian grounds, directs him release on interim bail for a period of four weeks from the date of such release. Learned Court in seisin shall fix the terms.
Additionally, it is directed that during currency of the interim bail period, the Petitioner shall appear before the jurisdictional police station once a week on such date and time to be fixed by the learned Court in seisin, and shall attend the trial on the date fixed.
On expiry of the interim bail period, the Petitioner shall surrender.
I.A is accordingly disposed of.
List the BLAPL on 26.09.2023.
Urgent certified copy of this order be granted in course of the day.
