The matter arose when a special POCSO court in Nagpur imposed costs on a police constable, Santosh Ramteke, for serving summons via mobile phone. The trial court held that electronic service was “not allowed” and directed recovery of costs from the constable.

However, the High Court, led by Justice Urmila Joshi-Phalke, set aside the order, ruling that the trial court had ignored the amended provisions of the BNSS. The Court clarified that once a summons is effectively conveyed through electronic means, it is legally valid and binding.

The Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, which replaced the colonial-era Criminal Procedure Code (CrPC), introduced several digital reforms:

  • Electronic service of summons is explicitly recognized.
  • Courts and police can use mobile communication, email, and messaging apps to serve notices.
  • The objective is to reduce delays and ensure faster communication in criminal trials.
  • Proof of delivery (such as double ticks or screenshots on WhatsApp) can serve as evidence of service.

This modernization aligns with India’s broader push towards e-governance and digital justice.

Why This Matters

The ruling has wide implications:

  • Efficiency: Digital summons reduces delays caused by traditional postal service.
  • Cost-saving: Saves resources for police and courts.
  • Accessibility: Ensures parties receive notices instantly, regardless of location.
  • Legal clarity: Confirms that electronic service is not just permissible but enforceable under BNSS.

While the judgment is progressive, experts caution about potential challenges:

  • Authenticity: Ensuring that summons is sent from official accounts.
  • Proof of receipt: Courts must verify that the recipient received and read the summons.
  • Misuse risks: Safeguards are needed to prevent false claims of service.
  • Right to fair hearing: Digital service must not compromise the accused’s ability to respond.

Reactions

  • Legal experts hailed the ruling as a “landmark shift” towards digital justice.
  • Police officials welcomed the clarity, saying it would reduce unnecessary penalties and speed up their work.
  • Civil rights groups urged caution, stressing the need for robust safeguards against misuse.
