In a significant judgment, the Bombay High Court has held that once a quasi‑judicial authority rejects a deemed conveyance application on merits under the Maharashtra Ownership of Flats Act, 1963 (MOFA), a fresh application framed in a modified form cannot be entertained. Justice Amit Borkar emphasized that the principle of res judicata applies equally to quasi‑judicial proceedings, ensuring finality in adjudication and preventing repeated litigation.

The dispute involved cooperative housing societies occupying different portions of a large plot in Andheri, Mumbai. While some societies consisted of bungalows and row houses, others included towers. In 2017, an application for deemed conveyance was rejected on merits by the District Deputy Registrar.
