Heard Mr. Koomar Chakraborty, learned counsel appearing for the petitioner. None appears for the respondents. However, Mr. S. Das, learned counsel appeared on behalf of Mr. D. Bhattacharya, learned senior counsel for the respondents and has sought for an adjournment due to certain personal reasons.

Mr. Chakraborty, learned counsel has submitted that today he has prepared the case to argue and that the learned counsel for the respondents should have informed the matter earlier that he would seek an adjournment today.

By an order dated 29.01.2024, this Court directed the learned counsel for the respondents to produce the file of the departmental proceeding of the petitioner today, but neither they appear nor they produce the proceeding file of the petitioner.

In view of this, I impose a cost of Rs.5,000/- upon the respondents – TMC to be paid to the High Court Bar Association within a period of 7(seven) days from today.

List the matter on 12.02.2024.
